Woman found guilty of contravening counterfeit goods

A 46-year old woman from Emalahleni was sentenced after she was found guilty of dealing in counterfeit goods.

Chetty Thoumaneey (46) was convicted by the Witbank Magistrate’s Court for contravening the provisions of the Counterfeit Goods Act.

On Monday, April 22, Thoumaneey was found guilty and sentenced to a R67 000 fine or three years imprisonment wholly suspended for five years on condition that the accused is not convicted of the same offense during the period of suspension for dealing in counterfeit goods.

She was also sentenced to a R3 000 fine or three years imprisonment for possession of counterfeit goods.

According to Hawks Spokesperson Captain Dineo Sekgotodi, a search and seizure operation was conducted and executed by the Hawks Middelburg-based Serious Commercial Crime Investigation unit together with members of Adams and Adams counterfeit brand holders at eMalahleni.

“In July 2022, 13 drums of Fusch petroleum counterfeit oil, one drum of Castrol counterfeit oil, and one drum of Engen counterfeit oil were found seized. All 15 drums of counterfeit oil were taken for analysis by the brand holders,” Sekgotodi informed.

She said that in August 2022, a J175 was served to Thoumaneey to appear in court.

“The accused appeared before the Witbank Magistrate’s Court on several occasions facing charges of contravention of the Counterfeit Goods Act,” Sekgotodi further outlined.

 

All seized goods are to be handed to the intellectual property owners/brand holders.
