UPDATE: Drug accused senior’s trial stayed

After the arguments were heard in the Richards Bay Magistrates Court last week, the matter was struck off the court roll.

BRACKENHAM pensioner, Govindama Moodley (69) who was charged with possession of drugs and suspected stolen property in March 2013 was granted a stay of prosecution last week, bringing the trial to a halt.

After the arguments were heard in the Richards Bay Magistrates Court last week, the matter was struck off the court roll.

A stay of proceedings is a ruling by the court in civil and criminal procedure, halting further legal process in a trial, but the court can at a later stage lift the stay and resume proceedings.

Moodley was released on R8 000 bail, following her arrest at her Cibotium Street home in Brackenham on 1 March 2013 where she was reportedly found in possession of five blocks of cocaine, 10 mandrax tablets, a bucket of dagga and stolen property including cell phones and jewellery.

In an affidavit, read by her attorney, Moodley denied the possession charges and said it was a ploy by police to falsely implicate her.

She further indicated she is a diabetic, suffers from high blood pressure and is in poor health after amputation of her leg.

She added that she runs a home industry business and has two people in her employment

Though she has no pending cases, she has four drug related convictions.
