Here's what steps motorists must take after receiving Aarto infringement notice

A KZN motorist has been issued an Administration and Adjudication of Road Traffic Offences (Aarto) notice for a reported traffic infringement.

The motorist was handed the infringement notice electronically generated by RTI at the Mariannhill Toll Plaza on Tuesday.

It follows the rollout of phase 2 of the Aarto Act at 62 municipalities, including some in the KZN province.

The motorist who received the notice on Tuesday will have 32 days from receipt to take action and will have to pay the penalty imposed within these 32 days to benefit from a 50% discount.

“Instead of paying, the motorist can apply to pay in instalments. In this regard, the motorist will submit a formal representation or elect to submit the matter to the tribunal for adjudication.

“If the motorist submits a representation explaining why he is not liable, an independent RTIA-appointed representations officer will evaluate the case.

“The Road Traffic Infringement Agency (RTIA) will notify the motorist of the decision. If successful, the fine will be cancelled.

“If rejected, the motorist can elect to take the matter to court for trial within a prescribed timeframe,” said KZN Transport MEC Siboniso Duma.

Should the notice be ignored, a letter will be issued to the motorist if he fails to respond or pay within the initial 32 days, demanding payment or action.

“If it is still ignored after another 32 days, an enforcement order will be issued, blocking the motorist from obtaining vehicle licenses, driving licenses, or professional driving permits. No transaction can be done through the motorist’s Identification Number,” said Duma.

Demerit system implementation

The demerit point system will be implemented at a later stage on a date set to be announced by the transport minister.

This penalises drivers for various traffic violations through a points system, potentially resulting in the suspension or cancellation of a driver’s licence.

“This is the final and critical phase. During Phase 4, recorded points will accumulate against the motorist’s driving record.

“When the allocated threshold of 15 points has been exceeded, the driving license will be suspended or cancelled,” said Duma.
