Kwa-Thema rape accused to spend another week in police cells

On Wednesday the defense and State gave their arguing statements as to whether he should be granted or denied bail.

Kwa-Thema – The 58-year-old father accused of raping his daughter since she was six years old will spend another week in the police holding cells before judgement on his bail is decided by the Springs Magistrate Court.

On Wednesday the defense and State gave their arguing statements as to whether he should be granted or denied bail.

The father has denied the rape allegations citing that his 24-year-old daughter is coached by the neighbours who she confided in, and helped report the matter to the police.

He has denied threatening his daughter and argued that on the said weekend he had not seen her but heard from his girlfriend that she was around.

The defence argued that though the community has submitted a petition for him to be denied bail; he will not go back to his home in Kwa-Thema but move to his relatives in Tsakani.

He is an employed father to a six-year-old who still depends on him financially and maintains his girlfriend and children.

The accused’s girlfriend submitted an affidavit stating that she slept over on Saturday and Sunday when the alleged recent rape occurred. A J88 report furnished to the court has revealed that the victim was recently penetrated and has visible injuries.

The defense further argued that they are not disputing the report but the suspect denies inflicting the injuries and has no idea whether his daughter has a partner or not.

Meanwhile, the state argued for the victim to be denied bail stating that there is a likelihood of intimidating the witnesses and victim.

Due to the seriousness of the case should the suspect be granted bail, there might be a public outcry from the community which may lead to public violence.

The matter has been postponed until December 8 for the verdict on the bail to be delivered.
