Councillor encourages Ekurhuleni residents to check land use by-laws
A councillor calls on residents to give their input on the revision of the city’s Spatial Planning and Land Use Management By-laws before the October 9 deadline.
Councillor urges community members to have their say on the revision of the city’s Spatial Planning and Land Use Management By-Laws of 2019.
According to Ward 18 Clr Heather Hart, every community needs law and order.
“Without law and order, confusion will set in.”
Hart explained that city planning determines where people work and live.

“It is a town’s first form of law and order; you can’t have residential areas mixed into industrial areas. The next level is town planning schemes, zoning and the availability of consent use applications.”

Hart explained that order comes from by-laws, and that in SA, the overriding Act is the Spatial Planning and Land Use Management Act.
According to Hart, the by-laws are revised every five years.
“It gives community members the chance to check their land use rights and rectify uncertainties,” said Hart.
She said the city takes infringements seriously, particularly in suburban areas, former towns and townships, to create a safe, secure environment for all.

“The city is often willing to help rectify discrepancies, but ongoing infractions might result in punitive measures.
“When unlawful land use is reported, town planning inspectors will want to inspect the property. If they find contraventions, the owner will receive a notice detailing the problem and who to contact.”
Hart said many community members ignore by-laws at their own peril.
“Don’t start a motor workshop, build back rooms, a nursery school or a swimming school without the necessary permission,” said Hart.
