EMPD speaks out against noise issue at local swimming pool

Regarding a recent letter that was published in the City Times about noise at the Benoni Northerns Swimming Pool, the EMPD have provided the by-laws and advice to residents about how to respond in such situations.

EMPD media liaison officer Kobeli Mokheseng explained ‘noise’ falls under the by-law category ‘disturbance of peace’:

No person shall without the consent of the Ekurhuleni Metropolitan Municipality (EMM) in writing, play or permit the playing of any music, or use or permit the use of any loudspeaker or public address or other audible devices on or adjacent to or which may be heard in any street or public place.

No person shall disturb the public peace in a street or public place or on private premises by making noises or causing them to be made by shouting, quarrelling, fighting, singing or playing any type of musical or noise-creating instrument or by means of a radio, loudspeaker or similar device, or by riotous, violent or immoral behaviour.

Mokheseng said if the rezoning was done by relevant government or municipal departments and permission granted for such to take place, the time will be stipulated on the permit or licence of such entertainment place.

“If the occasion or event is deemed to be a party celebration then there would be an agreement between the neighbours and organisers prior to the party celebration,” he said.

If the disturbance continues, EMPD members can be called out to issue a verbal warning and request for the music to be lowered.

“The second step, we impound the sound system,” he explained.
