Notice of Public Participation Process is hereby given in terms of Section 41 of the National Environmental Management Regulations, 1998 (NEMA) (Act No. 107 of 1998), for a Waste Management Licence (WML) application under the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008).
Upward Mining (Pty) Ltd is applying for a Waste Management License to reclaim and rehabilitate the existing mine tailings that resulted from previous mining activities, in accordance with the requirements of the EIA 2014 Regulations (as amended in 2017). The proposed rehabilitation project will take place on Portion 470 of the farm Vlakfontein 69 IR, located in Benoni within the Magisterial District of Ekurhuleni District Municipality, covering an area of 15.2498 Hectares.
The proposed activity will trigger Category A activity 14 and 15 of the Waste Act of 59 of 2008 and GNR 517 activity 21(f) which triggers a Basic Assessment Report.
The primary objective of this project is to reclaim the mine waste material and mitigate the environmental damage caused by prior mining operations. The land will be restored to its original capabilities before the mine waste accumulation, making it available for alternative land uses. The description of the listed activities is as follows:
•Category A (Activity 14)
The decommissioning of a facility for a waste management activity listed in Category A or B of this Schedule. `Category A (Activity 15)
The establishment or reclamation of a residue stockpile or residue deposit resulting from activities which require a prospecting right or mining permit, in terms of the Mineral and Petroleum Resources Development Act, 2002 (Act 28 of 2002). `GNR 517 (2021), Activity 21F
Any activity including the operation of that activity required tor the reclamation of a residue stockpile or a residue deposit as well as any other applicable activity as contained in this Listing Notice or in Listing Notice 3 of 2014, required for the reclamation of a residue stockpile or a residue deposit. `GNR 327 (2017) Activity 19
The infilling or depositing of any material of more than
10 cubic metres into, or the dredging, excavation, removal or moving of soil, sand, shells, shell grit, pebbles or rock of more than
10 cubic metres from
a watercourse.
