Indictment served: AKA murder case moves to Durban High Court

The murder case of rapper Kiernan “AKA” Forbes and Tebello “Tibz” Motsoane is heading to the Durban High Court where seven co-accused will be in the dock.

THE indictment has officially been served on Siyabonga and Malusi Ndimande who will join the five other accused in the murder trial of Kiernan ‘AKA’ Forbes and Tebello ‘Tibz’ Motsoane for pre-trial conference on June 19 at the Durban High Court.

The brothers made a brief appearance at the Durban Magistrate’s Court today (April 17) where it was confirmed by Magistrate Ashwin Singh that the matter was now ready to be transferred to the High Court. Siyabonga and Malusi, who were extradited from Eswatini in November, will be joined by Lindokuhle Thabani Mkhwanazi, Lindani Zenzele Ndimande, Siyanda Eddie Myeza, Mziwethemba Harvey Gwabeni, and Lindokuhle Lindo Ndimande when they make their first appearance at the Durban High Court.

Represented by attorney Sibusiso Dlamini, the Ndimande brothers seemed relaxed in the dock as they talked among themselves while casually looking around court. They face a string of charges, including double murder and five counts of attempted murder.

When asked by Singh if they wanted the indictment to be explained to them in isiZulu, both the brothers declined, saying “our lawyer will explain it to us”.

Concluding the proceedings, Singh remanded Siyabonga and Malusi back into custody until their next appearance at the Durban High Court. “As you previously declined to apply for bail, you will be remanded back into custody until your next court appearance at the high court where you will be joined by the other five co-accused,” said Singh.

In February 2023, Forbes and Motsoane were shot and killed outside a restaurant on Florida Road, just outside the Durban CBD. The trial dates have been set for July 20 to August 21 and October 5 to November 6.
