Court in Brief

The following cases were recently finalised at the Boksburg Magistrate's Court:

Murder and kidnapping
David Seola (42) from Lindelani informal settlement was sentenced to an effective 18 years behind bars for murder and kidnapping on May 2.

He pleaded not guilty on January 19 and was found guilty as charged on March 2.

On September 4, 2021, he hit and kicked Thabo Lepekala Qhoqho to death in the furtherance of a common purpose after forcing him inside the car to commit the offence.

He was sentenced to five years behind bars for count one (kidnapping) and 18 years’ imprisonment for count two (murder). The sentence for count one will run concurrently with the sentence for count two.

Magistrate Harichand presided over the matter and prosecutor Lingani represented the State.

Theft
• Allen Oratilwe Masanabo (23) from Pretoria was sentenced to a R500 fine or five months in prison, wholly suspended for five years, for theft on May 3.

He pleaded guilty and was found guilty on the same day of sentencing.

On March 15, he stole brown bread, wine and two-minute noodles to the value of R282.98.

Magistrate Mhmane presided and prosecutor Kwhela represented the State.

• Princet Ncube (25) from Johannesburg was sentenced to four months in prison on May 2 for theft and being in the country illegally.

He pleaded guilty and was found guilty on the same day of sentencing.

It was found the Zimbabwean national was also illegally in the country. Both counts (theft and contravention of the Immigration Act) were taken into one for sentencing.

On March 19, she stole items to the value of R516 from Woolworths.

Magistrate Mtmane presided and prosecutor Kwhela represented the State.

• Elmarie Beytell (41) from Boksburg was sentenced to a R6 000 fine or six months imprisonment, wholly suspended for five years for stealing on May 2.

She pleaded guilty and was found guilty on the same day of sentencing.

On January 12, she stole items to the value of R1 067.22 from SPAR.

Magistrate Havenga presided and prosecutor Lingani represented the State.

Receiving stolen property
Nathan van Niekerk (28) and Robert Nel (34)from Boksburg received hefty sentences on May 8 for receiving stolen property.

They both pleaded guilty and were found guilty on the same day of sentencing.

Van Niekerk was sentenced to 18 months imprisonment while Nel was sentenced to 18 months imprisonment, of which nine months imprisonment is suspended for five years.

They are both declared unfit to possess a firearm.

Housebreaking with the intent to steal and theft
André Leon Bishop (38) from Boksburg was sentenced to two years behind bars and declared unfit to possess a firearm on May 2 for housebreaking with the intent to steal and theft.

He pleaded guilty and was found guilty on the same day of sentencing.

On November 30, last year, he broke into a house in Atlasville and stole spanners, plumbing equipment, a computer, bolts and nuts and verriors valued at R10 000 from Ceilings and Partitions Hardware.

Magistrate Havenga presided and prosecutor Lingani represented the State.

• Benjamin Jacobs from Reiger Park (26) was sentenced to three years behind bars on May 2 for housebreaking with the intent to steal and theft.

He pleaded guilty and was found guilty on the same day of sentencing.

On March 2, he broke into a house in Reiger Park and stole a cellphone, laptops, wheel caps and clothing to the value of R62 135.49.

Magistrate Havenga presided and prosecutor Lingani represented the State.

On January 23, they took three bags and a suitcase with clothes inside and a two-plate stove.
