Community members weigh in on labola ruling

While some residents feel the ruling protects long-standing cultural practices, others believe couples should have more freedom to decide how their finances will be handled- especially in today’s economy.

South Africa’s Constitutional Court has ruled that once a customary marriage exists, couples are automatically married in community of property – and that arrangement cannot be changed later.

The Boksburg Advertiser asked a few locals whether they believe the law should stick closely to traditional labola practices or allow couples to decide their own property arrangements?

Petrus Mofokeng: I think couples should be able to choose whether they want to be married in or out of community of property. It should be up to the couple getting married.

Mirinda van Nieuwenhuizen: I think it’s unfair. It takes away a person’s independence and removes their right to choose what works best for them.

Josias Mopedi: I think the law should stick to traditional practices because people are familiar with the process and it’s how things have always been done.

Ronel Steenkamp: I believe traditional practices should be kept, but many couples are both working these days. Automatically being in community of property can take away a person’s independence.
