Pyne’s recusal application denied

Jaén-Lee Pyne’s legal team alleged bias and a violation of his right to legal representation, but the magistrate ruled the claims were unfounded, with no evidence of unfairness presented.

In a significant ruling, the recusal application filed by Jaen-Lee Pyne and his legal team to remove Magistrate Michael Twala from his assault (GBH) and malicious damage to property case has been denied.

This case has been on the court’s roll since January 2023.

Initially presented on July 11, the recusal application included allegations of bias against Twala, with the defence expressing concerns that Pyne would not receive a fair trial.

The proceedings were subsequently postponed to July 17 for the magistrate to assess the claims.

During the resumed court session, Twala requested clarification from Pyne’s legal representative about the number of attorneys who had represented him in this matter, which totalled five, including a representative from Legal Aid SA.

The organisation’s involvement was the result of Pyne’s financial constraints, highlighting his inability to afford long-term private legal representation.

The defence also challenged Twala’s conduct, claiming infringement on Pyne’s rights to legal representation.

Furthermore, it was noted that the recusal application was initiated under the guidance of Pyne’s current legal counsel.

In his ruling, Twala emphasised that the case had not yet gone to trial and no witnesses had been called to testify thus far. He said the bias allegations were unsubstantiated and hastily made.

Consequently, the application for recusal was dismissed, with no evidence presented to support the claim of bias.

Following the ruling, Pyne’s legal representative announced intentions to lodge an appeal, but was informed that such an appeal must be made to the High Court because appeals at the magistrate level had been denied.

The appeal result will be forthcoming on August 25, coincidentally the same day Pyne faces court for charges related to murder, attempted murder and the discovery of a body at the premises where he lived.

Pyne is out on bail but remains in custody on a separate charge.
