NOTICE OF PUBLIC PARTICIPATION PROCESS FOR PROSPECTING RIGHT APPLICATION THROUGH A BASIC ASSESSMENT PROCESS ON THE FARM RIETVLY 600 IR WITHIN THE MAGISTERIAL DISTRICT OF BALFOUR, MPUMALANGA PROVICE. (DMRE REF: MP 30/5/1/1/2/19868 PR) Musuthu Holdings has lodged an application for coal prospecting right in terms of Section 27 of the Mineral and Petroleum Development Act, 2002, as amended by section 23 of the Minerals Development Amendment Act, 2008 (Act 49 of 2008). The application for environmental authorization for the prospecting right is being done in terms of the 2017 Environmental Impact Assessment Regulation, GNR 326, as amended.
DESCRIPTION OF THE PROJECT The proposed prospecting activity will rely on non-invasive techniques and core drilling of fifteen (15) exploratory holes. All drilling shall be undertaken to a maximum depth of 110 meters. The proposed prospecting site covers a total area extent of 4387,7 ha and is situated about 15.2 km South of Balfour and 22,1 North of Villers within the Magisterial District of Balfour, Mpumalanga Province.
LEGAL REQUIREMENTS
• (a) associated infrastructure, structures, and earthworks, directly related to the prospecting of a mineral resource (,); or (including activities for which an exemption has been issued in terms of section 106 of the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002)
(b) the primary processing of a mineral resource including winning, extraction, classifying, concentrating, crushing, screening or washing; but excluding the secondary processing of a mineral resource, including the smelting, beneficiation, reduction, refining, calcining or gasification of the mineral resource in which case activity 6 in Listing Notice 2 applies.
G.N.R 327 Listing Notice 1, Activity 27: The clearance of an area of 1 hectare or more, but less than 20 hectares of indigenous vegetation, except where such clearance of indigenous vegetation is required for-
(i) the undertaking of a linear activity; or
(ii) maintenance purposes undertaken in accordance with a maintenance management plan. All Interested and Affected Parties (I&APs) are hereby invited to comment on the Draft Basic Assessment Report (BAR) and Environmental Management Program (EMPr).
