NOTIFICATION OF AN ATMOSPHERIC EMISSION LICENCE (AEL) APPLICATION PROCESS IN TERMS OF THE NATIONAL ENVIRONMENTAL MANAGEMENT: AIR QUALITY ACT (ACT NO. 39 OF 2004) FOR PCS FOUNDRY IN VULCANIA, BRAKPAN SEC Ref No: 26-012
Background: PCS Foundry is an existing operating foundry which produces a combination of stainless steel, ferrous and non-ferrous metals castings. The foundry is located on Portions of Erven 8, 149, 168 and 169 of Vulcania, an industrial area of Brakpan within the Ekurhuleni Metropolitan Municipality (EMM) of Gauteng. The site is bordered by Empire Street to the north and Milne Street the south. The foundry was established as Pump Casting Specialists in 1985, with the name change to PCS Foundry taking place in 2003. PCS Foundry`s castings are produced by melting various elements in induction furnaces, alloying, moulding, and finishing. Raw materials such as iron and steel scrap, sand and sand additives are stored and handled at the site. Application Description: The site operated under the authorisation of a Registration Certificate issued in terms of the Atmospheric Pollution Prevention Act, 1965 (Act No 45 of 1965) (APPA). The National Environmental Management: Air Quality Act (Act No. 39 of 2004) (NEM:AQA) repealed APPA, with the APPA Registration Certificate expiring at the end of the transitional arrangement period provided for in Section 61 of NEM:AQA. The foundry has therefore initiated an Atmospheric Emission Licence (AEL) application process in terms of Section 22A of NEM:AQA. Rayten Engineering Solutions (Pty) Ltd has been appointed to undertake the AEL application process in accordance with Section 37 and 38 (3) of NEM:AQA.
The activities at the foundry triggers one listed activity in terms of S21 of the NEM:AQA, namely sub-category 4.10 (foundries).
Section 38 of NEM:AQA stipulates Section 24 of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA) applies to all AEL applications. However, no listed activities in terms of the NEMA Listing Notices 1, 2 and 3 2014 (as amended) are triggered by the activities at PCS Foundry, therefore no NEMA EIA process is required. This was confirmed in a NEMA Pre-application query response letter from the Gauteng Department of Agriculture, Rural Development and Environment (GDARDE), dated 11 June 2026 (Reference: Gaut 001/26-27/0106). Opportunity to Participate: In terms of Section 38 (3) of NEM:AQA, the AEL application must be brought to the attention of potential Interested and Affected Parties (I&APs). You are therefore invited to register as a stakeholder and submit your comments in writing within 30 days (on or before 18 August 2026). The AEL shall be available once it has been finalised at the end of the 30-day public comment period.
