731119 5806 181), an adult male purportedly residing at 2024 EXT 4, EMALAHLENI, 1039 and whose full and further particulars are to the Applicant unknown, and whose present whereabouts are unknown. TAKE NOTICE THAT you are in breach of the terms of the instalment sale agreement concluded with the Applicant in that you are in default of your monthly payments and are as 21 JULY 2025 in the sum of R33 761.78 in arrears. The total outstanding balance is the sum of R44 163.34. TAKE NOTICE THAT in terms of a Notice under Section 86(10) of the National Credit Act, Act 34 of 2005 (`the Act`), your debt review process is duly terminated. TAKE FURTHER NOTICE THAT the Applicant seeks an order on the following terms: 1. Confirmation of cancellation of the Agreement;
2. An order directing the Defendant to restore to the Plaintiff possession of the Goods, being a 2017 ISUZU KB 250 D-TEQ HO HI RIDER P with Engine Number: 4JK1RS9842 and Chassis Number: ADMNRCHR3H4822329;
3. In the event of the Defendant failing and/or refusing to return the goods to the Plaintiff forthwith, then and in that event the Sheriff of the above Honourable Court be and is hereby authorised and directed to enter upon the Defendant`s premises, or wherever the vehicle is being kept, to attach the goods and return same to the Plaintiff.
4. Retention of all monies paid to the Plaintiff by the Defendant;
5. Leave is granted to the Plaintiff to apply on the same papers for:
5.1. Damages, if any, in an amount to be calculated by subtracting the current market value of the Goods (as well as a rebate on unearned finance charges from the balance outstanding if applicable); 5.2. Interest on the said damages at the rate of 15.550% per annum from
01 JUNE 2025 to date of payment;
6. Costs of suit on the attorney and client scale;
7. Further and/or alternative relief.
