To the sheriff or his deputy:
INFORM: DAMIAN MARAIS, an adult male with identity number
930312 5107 085, whose full and further particulars are to the plaintiff unknown, and who resides at 37 DIE HEUWEL ESTATE FRANCOIS, WITBANK, EMALAHLENI,1034, also being his chosen domicilium citandi et executandi, which address falls within the jurisdiction of the above Honourable Court (hereinafter called the Defendant),
THAT:
NEDBANK LIMITED, a public company duly registered and incorporated with limited liability in accordance with the laws of the Republic of South Africa trading, inter alia, as bankers and credit providers in terms of the provisions of Act 94 of 1990 (as amended) and Act 34 of 2005 with its principal place of business situate at
135 Rivonia Road, Sandown, Sandton; (hereinafter called the plaintiff), hereby institutes action against the defendant for:
AS PER THE PARTICULARS OF CLAIM ATTACHED HERETO
INFORM the defendant further that if the defendant disputes the claim and wishes to defend the action, the defendant shall within ten (10) days of the service upon the defendant of this summons file with the Registrar of this Court at Cnr Beyers Naude & OR Tambo Street, Middelburg, 1055, notice of the defendant`s intention to defend and serve a copy thereof on the plaintiff`s attorneys, which notice shall give and address (not being a post office box of poste restante) referred to in Rule 19 (3) for the service upon the defendant of all notices and documents in the action.
THEREAFTER and within 20 days after filing and serving notice of intention to defend as aforesaid, file with the registrar and serve upon the plaintiff a plea, exception, notice to strike out, with or without a counterclaim.
INFORM the defendant further that if the defendant fails to file and serve notice as aforesaid, judgement as claimed may be given against the defendant without further notice to the defendant, or if, having filed and served such a notice, the defendant fails to plead, except, make application to strike out or counter claim judgment may be given against him. And immediately thereafter serve on the defendant a copy of this summons and return the same to the Registrar with whatsoever you have done there upon.
