NPA secures R18m property preservation order in Giyani

The NPA’s Asset Forfeiture Unit secured a preservation order freezing R18m worth of Giyani properties, including some along Kremertart Street.

LIMPOPO – The National Prosecuting Authority’s (NPA) Asset Forfeiture Unit (AFU) in Limpopo has secured a preservation order from the Polokwane High Court against four Giyani properties valued at over R18 million.

The order, granted on September 5, includes properties along Kremertart Street.

The ruling follows an in-depth investigation by the AFU, the Hawks, and the SAPS Anti-Corruption Unit. The properties are linked to alleged fraud, theft, money laundering, and violations of the Municipal and Public Finance Management Acts (MFMA and PFMA).

The court found that the properties were either obtained with the proceeds of unlawful conduct or used to commit criminal offences.

Court documents reveal that fraudulent property sales were allegedly facilitated by the late Willem Jakobus Fourie, Howard Alex Mashaba, and Magezi Ben Mashaba through Mbangwa Trading and Projects.

Payments ranging from R290 000 to R450 000 were reportedly made directly into Fourie’s personal account. However, the properties were never legally transferred and remain registered under the national government and Limpopo’s Department of Public Works, Roads and Infrastructure.

One notable case involved Erf 58B, where a government building was demolished and replaced with a hotel.

Regional NPA spokesperson Mashudu Malabi-Dzhangi said the preservation order is a key step in protecting state resources.

“This ensures that unlawfully acquired assets do not remain in the hands of those who benefited illegally,” she said. She also praised the cooperation between law enforcement units, calling it a model of effective collaboration.
