Pretoria East man recovering at home after being shot in the head
Len Cloete has been left wheelchair-bound after being shot in the head following an altercation with the police.
The Pretoria businessman, who was shot in the head by a police officer three months ago, is now back at home and recovering.
Len Cloete, the owner of a gym in Rietvalleirand in the east of Pretoria, was injured during an altercation with police at a Muldersdrift Misty Hills lodge.
He was shot in the head when he disarmed one of the officers during a heated argument. A bullet was lodged in his head and he had to undergo surgery to have it removed.
Since then, Len has not been able to use one side of his body and he is undergoing rehabilitation at a medical facility.
Specialised Security Service’s private investigator Mike Bolhuis said the wheelchair-bound Len was discharged from the centre on Tuesday and was with his family at home.
“They had to do some alterations to accommodate him at home because he has limited movement.”
Bolhuis said Len was still unable to walk or talk and had limited movement on one side of his body.
He said his treatment and rehabilitation would continue from his home. He emphasised that Len’s road to recovery was still a long one.
“He has very limited speech. He understands his wife and she understands him,” he said.
“At home, he is with his family and he should be able to move a lot more than he could at the hospital.”
On the day of the incident:
A video did the rounds on social media, showing Len drawing a gun and cocking it during what seemed like a heated argument with police officers.
A female police officer can be heard saying: “now you are playing dangerous” as she and other officers draw their guns.
Moments later, Len grabs the female police officer’s gun, after which another officer shoots him in the head.
Even though the exact reasons that led to the altercation were unknown, Len faces charges of robbery, assault and malicious property damage.
Is Len fit enough to give answers?
The specialist private investigator handling the case Luke Enslin said the progress of the three cases under investigation would rely on Len’s recovery.
He said Len would have to be fit enough to tell his side of the story.
The three investigations include one by police against Len, another by Independent Police Investigating Directorate (IPID) into the police’s conduct on the day and a civil case Len’s wife Chantal, opened against the police.
“The investigation by police as well as IPID will need the decision of prosecutors on whether they would continue with the investigation or leaving it,” he said.
“Len has to be fully compos mentis. He has to stand in court and be able to state whether he is guilty or not.
“He is not fit enough to go to court and answer any charges against him in court, so they need a few documents and reports and that investigation will be placed before a senior public prosecutor.”
He said in the civil case against the police, Chantal argued that the police officers that dealt with the situation on the day acted unlawfully by shooting her husband.
Enslin said Chantal wanted compensation for the financial shortfall caused by Len’s inability to work and for his medical bills to be paid.
“She believes that there were enough police on that day to arrest her husband before matters escalated to where they did,” he said.
“She is of the view that there was enough time for him to have been arrested before he was armed or when he put his firearm away.”
He said the civil case would also argue the competence of the police officers on that day and how their actions have led to Len’s inability to run his businesses.
IPID spokesperson Grace Langa said they would be relying on medical professionals to give reports on Len’s ability to give his version of events.
“Our main focus is the mental part, not his physical recovery,” she said.
“We will rely on a report from the doctor on his state. That will give us directive on his mental capability to give his version of events.”
In the event Len is never able or fit enough to give information, Langa said the National Prosecuting Authority would be engaged for a way forward.
