SA Lockdown: Cabinet to appeal High Court judgment

Regulations announced by the president were taken with the aim of saving lives, the Minister in the Presidency, Jackson Mthembu, announced this afternoon.

Cabinet has decided to, on an urgent basis, appeal the judgment by the North Gauteng High Court which was made on Tuesday, which declared lockdown regulations on level three and four unconstitutional and invalid.

This was announced this afternoon by the Minister in the Presidency, Jackson Mthembu.

After consulting with the legal fraternity, cabinet believed another court might come to a different conclusion, according to Mthembu.  He added that the appeal would be lodged through the same court and, if necessary, cabinet would approach the Supreme Court of Appeal at a later stage.

The minister also announced that cabinet has decided to extend the National State of Disaster by another 30 days, to run from 15 June to 15 July.

Cabinet, he said, wishes to ensure the nation that the regulations on the movement of people, as announced by the President, Cyril Ramaphosa, since the start of the lockdown, were directed with the aim of saving lives.

“While government appeals the judgment, current regulations remain in force and we urge everyone to observe health protocols as prescribed,” he said.

He said the Minister of COGTA, Nkosazana Dlamini-Zuma, would in the appeal by joined the president, and the Minister of Health, Zweli Mkhize.

He said the president remained concerned about the increase of Covid-19 infections in the Western Cape and would visit the area tomorrow, joined by among others, the ministers of health, defense, police and basic education.
