Suspended Pietermaritzburg magistrate seeks recusal of presiding officer

Magistrate Ashin Singh seeks recusal and removal in his disciplinary hearing, citing bias and delays over alleged threatening messages to journalists.

Suspended Pietermaritzburg senior magistrate Ashin Singh has called for the recusal of presiding officer Magistrate Ian Cox from his ongoing disciplinary hearing.

Singh also applied for the removal of Magistrate’s Commission representative Magistrate David Mhango, accusing him of delaying proceedings by failing to provide key documents.

The hearing, which resumed at the Pietermaritzburg High Court yesterday, centres on allegations that Singh sent ‘inappropriate, concerning and threatening’ WhatsApp messages to journalist Greg Ardé, who wrote an article for the Daily Maverick titled: NPA, Magistrate’s Commission asked to probe KZN magistrate’s murky immersion in spying and politics.

He is also accused of sending similar messages to AmaBhungane managing editor Stephen ‘Sam’ Sole, who commissioned the article.
