Vanderbijlpark scholar transport crash: Driver appears in court
State prosecutors have opposed bail for the man accused of killing 14 children in a crash on the R553 outside Vanderbijlpark.
A scholar transport driver accused of murder remains behind bars as the Vanderbijlpark Magistrate’s Court prepares to deliver its bail judgment next week, reports Sedibeng Ster.
Ayanda Dludla (23) appeared in court yesterday (September 4) for a formal bail hearing.
He was behind the wheel when his minibus taxi collided head-on with a heavy truck, resulting in the deaths of 14 schoolchildren.
Dludla faces 14 counts of murder, three counts of attempted murder, and a charge of driving without a permit.
Although he previously abandoned his application, his lawyer, Reward Nxumalo, told the media that his client was remorseful and battling to come to terms with the tragedy.
Yesterday, the state strongly opposed Dludla’s release.
State Prosecutor Titus Daniso argued that Dludla failed to meet the necessary bail requirements under Section 60 and Schedule 5 of the Criminal Procedure Act 51 of 1977.
“He has not mastered the test and has not shown himself to be a candidate to be released on bail,” Daniso said.
The prosecutor argued that the matter should proceed to trial as the state is ready to present its case.
Unlike previous appearances that drew large crowds of protesters and a full gallery, yesterday’s hearing was attended by only a handful of people.
Nxumalo argued that the quiet atmosphere showed it was safe for Dludla to return to the community.
“We are simply trying to get him out on bail so he can build a proper defence against the state,” Nxumalo said.
The defence lawyer also dismissed concerns that Dludla might flee to family in KZN.
He said Dludla would remain with his mother if granted bail.
“He is not bringing the bail application due to arrogance but is applying the law of the country pending the matter,” Nxumalo said.
The magistrate is scheduled to deliver the bail judgment on Wednesday (September 9).
