Pay up or you’re in the dark, says court
The Ballito Bay Mall, which went into liquidation in 2013, was bought from the liquidators last May by Cyber Savvy Merchants (Pty) Ltd for R135 million.
The liquidators of the ill-fated Ballito Bay Mall were given five days to settle the outstanding R16,5 million electricity bill – or face disconnection on the eve of the Festive Season.
The mall, which went into liquidation in 2013, was bought from the liquidators last May by Cyber Savvy Merchants (Pty) Ltd for R135 million.
KwaDukuza municipality blocked the transfer until all outstanding rates and electricity fees were paid, finally making an urgent application to the Durban High Court during August.
At the end of October, KDM wrote to the liquidators and the remaining tenants of the mall demanding payment or the power would be switched off on November 15.
A legal tussle then ensued when the new owners brought an urgent application against the municipality to force them to continue supplying power.
Judge Dhaya Pillay heard the matter on November 15, with KDM arguing that the liquidators had not disputed the fact that the money was owed and the new owners, Cyber Savvy, had no right to ask for a delay in payment.
The judge agreed and gave the liquidators five days to come up with the money or face disconnection.
