TAKE NOTICE THAT by Summons sued out of this Court, you have been called upon to give notice, within 1 (one) month after publication hereof, to the registrar and to the Plaintiff`s Attorney of your intention to defend (if any) in action wherein STANDARD BANK OF SOUTH AFRICA LIMITED claims:
1. Confirmation of cancellation of the Agreement;
2. 1.An order directing the Defendant to restore to the Plaintiff possession of the Goods, being a 2018 BMW 320I A/T bearing engine number F0151907 chassis number WBA8A16040NU78676;
3. 1.Retention of all monies paid to the Plaintiff by the Defendant;
4. 1.Leave is granted to the Plaintiff to apply for:
4.1 1.1. Damages, if any, in an amount to be calculated by subtracting the current market value of the Goods (as well as a rebate on unearned finance charges from the balance outstanding if applicable);
4.2 1.1.Interest on the said damages at the rate of 13.728% per annum from date of service of Summons to date of payment;
5. 1.Costs shall be costs in the cause.
TAKE NOTICE FURTHER that if you fail to give such notice, judgment may be granted against you without further reference to you.

IT IS HEREBY ORDERED THAT:
1. The Applicant be granted leave to serve the summons and any other documentation or processes arising from the matter under the aforementioned case number on the Respondent by way of substituted service by means of:
1.1 Advertisement in a newspaper that circulates within the province of KwaZulu-Natal, South Africa, namely, the North Coast Courier.

2.Service in terms of prayer 1 shall be proven by way of an affidavit deposed to by the person who attended to such service and which affidavit shall set forth the way in which there has been compliance with this Order.

4.A copy of this Order shall be served as set out supra on the First and Second Respondent.
