GOT a fine to pay and you’re not quite sure how to go about it?

Senior Superintendent at the Department of Public Safety, Kumarin Naicker, advises motorists and the public on the correct procedures to follow when making a payment on a fine, according to NRTA 1993 of 1996 and Criminal Procedure Act 51 of 1977.

“There are four categories of notices,” states Naicker.

Section 56 Notices: Notices that are signed for by the driver as per the Criminal Procedure Act 51 of 1977 which is a direct summons from a traffic officer. This notice can only be paid at the Clerk of the Court in Vryheid before the stipulated court date. Prior to the court date, the motorist can pay the notice into the Municipal Banking Account: FNB, Branch Code: 270524, Account Number: 62016057699. Ensure that the reference number is given for updating purposes and to avoid a warrant of arrest being issued by the clerk of the court.

Section 341 Notices: This fine is written for offences and bylaws within the CBD, industrial area, suburbs and residences by Law Enforcement Officers. It is a smaller notice, not the A4 size. These notices must be paid within 30 days of issue to avoid a summons being issued by the Clerk of the Court. They can be paid at the Local Testing Grounds. Motorists who wish to pay via banking must use the following Municipal Account: Nedbank, Branch Code: 198765, Account Number: 1067379770. Ensure that the reference number of the Section 341 notice is given for updating purposes.

Section 54 – Summons: (via post or hand delivered) This summons is issued by all Section 341 Notices and must be paid at the Clerk of the Court only. Ensure that it is paid in time as per the court date stipulated to avoid a warrant of arrest being issued.

Warrant of Arrest: This is a document that is issued by the Vryheid Magistrates’ office, that commands that the offender be arrested immediately upon sight and brought before the court to be dealt with according to law. This Warrant is applicable to motorists who failed to pay the Sec56, Sec341 and Sec54 before the court date and who did not appear in court.

Motorists are also informed by a courtesy letter in the post.

Its is advised that the above information be kept safe and used by motorists to avoid trouble with the law.
