Man jailed for life following cold-blooded murder in Pomeroy

The Dundee Regional Court has sentenced Themba Mthethwa to life imprisonment for the fatal shooting of Sfundo Ndaba.

The Dundee Regional Court on Friday sentenced Themba Mthethwa (31) to life imprisonment for the murder of Sfundo Ndaba (37), committed in February 2023 in the Pomeroy area.

According to the National Prosecuting Authority (NPA), Mthethwa, Ndaba, and a witness attended a funeral on 11 February 2023. Later that day, the witness saw both men heading to a nearby house where alcohol was sold. A short while afterwards, the witness spotted Ndaba walking away from the area, followed closely by Mthethwa — who then shot him in the back before fleeing the scene.

Ndaba succumbed to his injuries a few days later. Before his death, he stated to the police implicating Mthethwa as his attacker.

Officer recorded Ndaba’s dying declaration

In court, Prosecutor Jabulile Nomfundo Zondi submitted Ndaba’s statement, which was accepted as evidence. She also led the testimonies of the eyewitness, the arresting officer, and the officer who recorded Ndaba’s dying declaration.

Mthethwa was convicted and sentenced to life imprisonment and was also declared unfit to possess a firearm.

NPA Regional Spokesperson Natasha Ramkisson-Kara welcomed the judgment, saying it reaffirmed the NPA’s commitment to ensuring that violent crimes are met with firm justice.
