Why is it so difficult for the police to charge Marius Fransman? Is there interference from the top that is stifling the investigation?
Congress of the People notes that in a poll conducted by a national newspaper this weekend, only 16.5% of the people have confidence in the law and order establishment in our country. A prolonged delay, such as we are seeing in the Fransman case, is alarming. It reduces confidence in the police even further.
What is happening in the Fransman case points to the hypocrisy of the ANC which pretends to champion women’s rights but when crunch time comes, retreats at speed in the opposite direction. The women’s league, meanwhile, has gone deep underground. It has nothing whatsoever to say about a fellow member, nothing at all.
The complaint against Fransman is serious. COPE therefore expects the police to treat it as such and to act without fear or favour. If they apply the law selectively it will undermine the rule of law. It is six weeks since Fransman’s personal assistant opened a case of sexual harassment against him. Nothing has happened since then. Why?
Law abiding citizens had expected to see the law taking its course. If Fransman is receiving preferential treatment because of his position in the ANC, the nation will conclude that one law applies to the ANC and another to the rest of us.
We reiterate that in many previous sexual harassment cases against prominent political personalities, police have tended to protect the perpetrators, not the women who had been sexually molested or violated. Such women have been woefully victimised by the ANC and thoroughly let down by the system.
COPE calls on the Commissioner of Police to act decisively. Fransman must be charged. If the police fail in their duty, COPE will mobilise civil society organizations to take to the streets and stage a placard demonstration outside the Head Office of the Minister of Police to demand the arrest of Fransman.
COPE believes implicitly in the principle that all are equal before the law. Furthermore, we believe that every citizen has the right to proclaim his / her innocence and have his / her day in open court. This is what must happen.
COPE will continue to stand up against the rampant abuse of women in our society. We will do so consistently and without fear or favour. It does not matter what standing a person has in society. We call on real men in our country to revolt against sexual harassment and rape. Men must isolate all men who abuse women and let them know that they are despicable cowards.
