State opposes bail for suspended police boss Shadrack Sibiya in Randburg court

Prosecutors argue that suspended Deputy National Police Commissioner Shadrack Sibiya should remain in custody as details of serious charges surface in court.

The state has urged the Randburg Magistrate’s Court to deny bail to suspended Deputy National Police Commissioner Lieutenant General Shadrack Sibiya, arguing that the case against him is strong and that he could interfere with witnesses.

Sibiya remains in custody as his schedule six bail application continues. He faces charges of rape, human trafficking, the sexual grooming of a 16-year-old girl, and a new charge under the Firearms Control Act. His defence team is requesting bail set at R20 000.

Investigating officer Sergeant Nokukhanya Ndlovu testified that the state’s case relies on witness statements, cell phone records, and electronic messages. The state alleges that electronic communications between Sibiya and the minor form part of the evidence.

On the rape and human trafficking charges, the state alleges Sibiya took three women to a Sandton restaurant before raping one of them at a hotel. The state also opposed bail on grounds of possible witness interference, presenting court evidence of attempts made to contact complainants and their families.

Sibiya has denied all charges. He stated that the sexual encounter with the adult complainant was consensual, and denied any involvement in human trafficking.

Regarding the allegations involving the minor, Sibiya claimed the material was sent to him without his solicitation and that he merely forwarded it back upon request. His defence noted that the presiding magistrate questioned this explanation.

The defence maintained Sibiya is not a flight risk, noting he did not flee, despite knowing of the investigation before his arrest. His legal team also submitted an affidavit denying any instruction to third parties to contact witnesses, while describing the firearm charge as a fishing expedition.
