Tshwane legal woes continue

This as the DA turns to the High Court to halt the appointment of a new city manager.

Despite the DA’s request to halt the appointment of a new Tshwane metro manager amid legal appeals, head administrator Mpho Nawa said the processes are going ahead.

Nawa said the procurement of the metro manager was currently underway.

“The process has not been halted, it is underway. Appointment of a city manager was one of the key things we were tasked with – to appoint a city manager which the metro had been without for a while and also attributed to the collapsing of the municipality.

“We established an independent board to undertake the procurement process after we advertised the post. We will wait for the procurement process to conclude and by 1 August we will know who the new city manager will be.”

A letter from the administrator’s legal team to the DA, read the process would only be put on hold should the Tshwane administration appeals be heard before 1 August.

This after the DA launched an urgent application on Friday with the North Gauteng High Court to immediately stop the process of appointing a city manager in Tshwane.

DA Randall Williams said the appointment could cause “irreparable harm” to the municipality.

“Any permanent appointment would in all likelihood be unlawful and it would fall to the council to address the consequences of such an appointment once it resumes office,” said Williams.

“The DA is satisfied that the immediate threat has been resolved, but will continue with its application on a normal basis.

“These decisions and processes need to be transparent and the DA will continue to fight this to ensure that the further unlawful appointment of an ANC-controlled city manager does not proceed and that the residents and their hard earned tax contributions are protected.”

The first court hearing that will determine the status of the appointment will be heard on 21 July.
