Moot preschool involved in court case after complaints
Residents of Ben Swart Street and surrounding areas registered a petition at the metro against a preschool in their area they accused of increasing noise levels in the area.
Little Graduates preschool in Ben Swart Street in the Moot received a summons following complaints about it allegedly being an illegal and unregistered business.
The process unfolded on August 29 and a summons was served on September 10 by the Tshwane metro.
This after residents in the area registered a petition and a complaint at the metro against the business early in July as they felt concerned about the implications of having a preschool in a residential area.
The residents also were concerned about safety and the business’ compliance with legal requirements.
One resident, who wants to remain anonymous for fear of victimisation, told Rekord the operation of the preschool has resulted in increased noise levels and disturbances “which significantly affect the peaceful environment of our neighbourhood”.
“There was also no prior communication or consultation with the residents regarding the establishment of the preschool. Such a significant change in the neighbourhood should involve a transparent process where residents can express their concerns and opinions,” the resident said.
Metro spokesperson Lindela Mashigo confirmed a complaint about the business was received by the City Planning and Development Division on July 12.
“A site visit was conducted immediately to verify the allegations. A case file for a place of childcare operation was opened and an investigation was launched. A scheme contravention notice was served to the principal of the institution on July 18,” explained Mashigo.
He said a follow-up visit was conducted on August 24.
“It was discovered that the contravention is still ongoing. The property was reported to credit control for implementation of non-permitted category and also referred to municipal court for prosecution,” noted Mashigo.
He confirmed the matter appeared in court on October 2 for the first time and was postponed to November 1.
The matter was again postponed to November 18 for proper instructions and submission of representations. According to Mashigo, the complainants were at all times informed of these developments.
“A ruling has not been made by the court yet,” he said.
The management of the preschool commented that as the issue of the zoning is still sub judice that “we cannot comment on the pending issues which are held in court”.
