DA requests PP to probe ties of security service company to Tshwane Deputy Mayor
The DA has lodged a complaint with the Public Protector to establish if Modise, who started Triotic Protection Services, is still financially benefitting from the company which was appointed onto a panel that provides Tshwane with watchman services worth R300-million.
The Public Protector’s office will look into Tshwane DA complaint that Tshwane Deputy Mayor Eugene Modise is financially benefitting from Triotic Protection Services.
The DA requested that the Public Protector launches an investigation into the alleged tax delinquent company to establish if Modise was benefitting from the company while serving as a public servant.
The complaint is currently being processed, according to Khulu Phasiwe, spokesperson for the Public Protector.
The DA lodged the complaint with the Public Protector on March 18.
DA Tshwane Spokesperson on Finance Jacqui Uys said the DA had previously written to Mayor Dr Nasiphi Moya to ask for the investigation.
Uys said the investigation was to establish if Modise, who started Triotic Protection Services, is still financially benefiting from this company which was appointed onto a panel that provides the city of watchman services worth R300-million.
“The governing coalition has since increased the budget of this tender to R615-million for this financial year,” Uys said.
“We are still awaiting a response from the mayor on both the commencement of, and the terms of reference of the probe into Modise.
“The DA also revealed that, while having a judgment against them for owing SARS R59-million, Triotic Protection Services was not only appointed to the City of Tshwane’s Watchman Services Panel, but was also awarded a R49-million tender with the Gauteng Health Department for security services.”
Uys explained that according to their website, Triotic also has other governmental contracts, leaving the question of how these were awarded without a tax clearance certificate, as this is a tender requirement in all spheres of government.
“The DA has, on three occasions, written to the Tshwane City Manager to investigate how this company was appointed to a panel to provide services to the city if they did not have a Tax clearance certificate.
“This has not yielded results, and the DA has now taken the step of approaching the Public Protector to probe these matters,” she explained.
Uys emphasised that the residents of Tshwane deserve a deputy mayor and MMC of Finance that puts their needs first, who is responsible with the public purse and the DA will not relent until the truth comes out.
However, Modise has fired back, accusing the DA of using the complaint as a diversionary tactic to draw attention away from the new administration’s achievements.
He believes the DA is trying to shift the focus from the good work being done in Tshwane to its own agenda.
“DA is clutching at straws, because they instituted forensic investigations and realised their nefarious intentions are not gaining traction and now rushed to Public Protector just to attempt to sway attention of the great work we are doing in serving the people,” said Modise.
He explained that there’s no conflict of interest between the security service company and him.
“I resigned when I became a councillor and there’s no conflict of interest because I was not a councillor then and I signed a declaration form, which is prescribed for that.”
He said the tender awarded to Triotic was awarded legitimately with 21 other companies.
“The contract was awarded way before I became a councillor in Tshwane. I declared all interests in all my companies when I assumed office,” Modise said.
Modise said as a South African citizen and a public servant, he is not above the law.
“I have been cooperating fully from the beginning since the issue was raised and will remain throughout the Public Protector’s investigation,” he said.
“The tax clearance for Triotic was valid when the contract was awarded and it’s a basic due diligence process conducted by all government institutions. The contract was awarded through a court,” Modise concluded.
