MAKHADO – The Makhado valuation tender and thus the valuation roll for 2014 to 2018 was been reviewed and set aside by the North Gauteng high court on July 25.

The awarding of the tender was described by the judge as “unlawful and unfair.” The first respondent, the Makhado Municipality, is to pay the costs of the court case. The second respondent was Siyabuselela Trading Enterprise 27 500 trading as Risuna Property Consultants.

Thinus Geyser, managing director of the company that instituted the case against the municipality, DDP Valuers in Pretoria, expressed his satisfaction with the judgment of the North Gauteng high court’s acting judge, Dario Dosio.

“It is good to see that they did not get away with dishonesty,” he said.”I am satisfied with the outcome of the case.”

The awarding of the tender from the onset was questioned and described as irregular.

It was found by a forensic expert and signature examiner that the signature of Wilfred Zulu, who represented the second respondent, was forged on documentation and it was stated that he was not even in the country on the date the documentation was allegedly signed in Giyani.

His work experience as was stated on documents, was also fraudulent, as it was found some work he claimed to have done, was done by other individuals and companies.

He also did not adhere to other tender requirements, such as the appointment of two assistant municipal valuers and a substitute municipal valuer. The company’s trading name was also not a registered entity name and he only supplied one year’s financial statements instead of three years’.

The judge set aside the award of the tender and declared it unlawful. He ordered the Makhado Municipality to evaluate the tenders submitted and within one month from the date of the court order, submit which tender should rightfully have been accepted.
