The Moosa family feels let down by the justice system after one of the suspects allegedly responsible for the kidnapping of Anisah Moosa in March was granted bail for a third time.
Masilo Kgafane was rearrested last week on a charge of theft by false pretence and released by the Tzaneen Magistrate’s Court on R1 000 bail.
Kgafane, Samuel Kobo and Benny Mudau were arrested on charges of kidnapping and attempted murder soon after Moosa’s kidnapping and were granted bail of R10 000 each. Kobo and Kgafane were rearrested the same day they had been released on charges of armed robbery in Lebowakgomo. They then appeared before the Sekhukhune Magistrate’s Court and were granted bail of R5 000 each.
Family Spokesperson Yusuf Abramjee said the release of Kgafane on bail, despite him facing serious charges is a serious indictment of the justice system. “The family feels that the justice system is letting victims down and that they are shocked about the recent court outcome of Kgafane. The family has now asked the National Prosecuting Authority (NPA) to appeal the bail decision in all three cases,” Abramjee said.
Family attorney Raeesa Rhemtula is quoted to have said that the family is very disappointed at the repeated granting of bail. They have instructed their attorney to ask authorities for a full and urgent investigation. The family has also written to the Ministry of Justice, Director of Public Prosecutions and National acting Police Commissioner for immediate intervention.
Limpopo Hawks Spokesperson Matimba Maluleke could not confirm the release of Kgafane for the third time.
