The assault case against three South African National Civic Organisation (Sanco) members was dismissed from court in terms of Section 174 of the Criminal Procedure Act.
The section of the act provides that if at the close of the prosecution’s case, the court believes there is no evidence that the accused committed the offence, it may return a verdict of not guilty.
Messrs Madoda Sigasa, Sibusiso Nkambule and Matsimela Moloi were accused of assaulting an ANC member during a confrontation between Sanco and the ANC on 3 November last year.
The incident occurred in Sakhile during a community meeting that Sanco organised.
