MIDVAAL. – MLM previously stated that the developer had not submitted any formal land use or building plan applications to the municipality to undertake the said development.
As such, the project is deemed illegal as the necessary processes (e.g., rezoning application, township establishment, subdivision, building plan submissions, an inspection of houses to ensure quality/compliance, etc.) were not followed prior to the commencement of this project. Without the above-mentioned processes being concluded, the houses constructed cannot be transferred to buyers and will, therefore, remain the property of the current landowner.”
MLM says it recently received numerous inquiries from members of the public regarding a “City Report” relating to the illegal housing development. In the City Report, it is stated that “NTHA Property won the case against Midvaal Local Municipality.”
It is further stated that MLM is directed to pay the costs of the application for leave and of the application for rescission.
Ntha Property Developers and the Midvaal Local Municipality are currently undergoing legal processes on the said housing development.
At this point in time, an interdict and demolition application lodged with the High Court is pending before the Court. No judgement has been passed by the Court.
As such, the headlines of the “City Report” are false and misleading.
MLM states that the Developer still needs to follow the required processes to submit a formal Township Establishment and Building Plan application to the Midvaal Local Municipality for consideration to ensure legislative compliance.
“Presently, no such application or approvals have been granted by the Municipality. Residents are still advised to refrain from purchasing any stands or houses in the said development as the development remains illegal.”
