Why is the marriage contract important?

The time of marriage is also the time for Estate Planning. The Antenuptial Contract must be executed with a Notary Public before the marriage and should be viewed as Estate Planning. The Antenuptial Contract will deal with what happens to your assets at the dissolution of marriage (by death or divorce). Marriage is also an important time to consider your Wills. It is very important that once children arrive that you consider creating a testamentary trust in your Will. This will ensure you dictate who looks after your assets and who provides for your children. When entering into an Antenuptial Contract with the Accrual System you are permitted to exclude assets you already own, i.e. paid up house, car, furniture, investments and pensions. Consulting with a Notary will give you the opportunity to consider various options and enter into the contract that suits your needs. The Antenuptial Contract automatically provides for the Accrual System or you can expressly exclude it. The Accrual simply means that the party with the smaller estate has the right to share in the accrual of the other spouse on dissolution of marriage (death or divorce). During the subsistence of the marriage, with or without the accrual, two separate estates exist. Each spouse manages and controls his or her own estate and can freely alienate, hypothecate, pledge and spend their assets. If a spouse is squandering his or her estate to prejudice the other, a Court Order may be obtained to cause a spouse to desist from such conduct. Assets which are excluded from the accrual: * assets excluded in the Antenuptial Contract; * inheritances, legacy and or donations; * and damages (i.e. disability payment received by a spouse).
