THE father of two girls, aged three and five years, pleaded guilty in the Port Shepstone Regional Court on Tuesday this week to charges relating to child pornography and sexually assaulting his eldest daughter.

Senior Magistrate Johann Bester read out the three charges, which included sexually violating a child, being in possession of child pornography and using his daughter to create child pornography.
The man pleaded guilty to being in possession of 277 images of children between the ages of three and 15 years involved in sexual activity, and admitted to unlawfully using his daughter (5) without her consent in ‘creating, making or producing images of child pornography’.
The initial charge included the younger daughter being used to create pornographic images, but the State indicated that it would no longer be pursuing that charge.
His plea included the following:
* He never penetrated his daughter in any way, but added “When I touched her I foresaw that my actions would be unlawful but nevertheless proceeded.”
* His daughter was not harmed physically and a medical examination by a state doctor indicated ‘no physical injuries whatsoever on her genitalia and the hymen shows no abnormalities whatsoever.’
* He suffered from ‘at least four recognisable mental disorders’ including antisocial personality disorder, a substance abuse disorder, paedophilia and dependent personality disorder, and asked that this be taken into account.
* In respect of being in possession of child pornography, a police search at the man’s home on April 29, 2016 resulted in two external hard drives, a laptop computer and a cellphone being seized. These were analysed by the Cyber Crime Unit of South African Police Services, and although no child pornography was found on the external hard drives, evidence of child pornography was found on the laptop and data on the cellphone contained images of child pornography.
* He confessed to being in possession of 245 images of child pornography on his laptop and 32 images on his cellphone – a total of 277. The images were of children and adults engaged in sexual conduct.
* With regards to the charge of ‘creating, making or producing images of child pornography’ he told the court that he created the images by photographing the child. Twenty-five of the images were of his daughter’s private parts and seven were of him rubbing the child on her clothing in the location of her private parts.
Magistrate Bester stressed that the State did not accept that the man was at the time ‘suffering from an increased criminal capacity’ and this did not have any bearing on his admission of guilt.
The man’s wife and children have left the country and he is currently living with his mother.
He is due to be sentenced in November.

A MARGATE man (38) is facing four charges ranging from sexual assault to possession of child pornography and using children for/or benefiting from child pornography.
He appeared in the Port Shepstone Regional Court last Wednesday and the case has been postponed to next month. He is currently out on bail.
The alleged crimes involve the sexual assault of his daughters, aged three and five, between May last year and April of this year.
According to police spokesman, Captain Gerald Mfeka, information was received from the British High Commission that the father was involved in the downloading of child pornography.
Members of the International Criminal Police Organisation (Interpol) arrested the man in his Margate home in June this year.
