NOTICE OF MOTION

KINDLY TAKE NOTICE

that the above- named Applicants intend to make application to this Honourable Court on the ____ day of ______________ 2026 at ________ or so soon thereafter as counsel may be heard for an order in the following terms:

1. That the Applicants be granted leave to change the matrimonial property regime applicable to their marriage by the execution and registration of a Notarial Contract, a draft whereof is annexed to the First Applicant`s Founding

Affidavit marked “SM1”

and which contract, upon registration, shall regulate the matrimonial property regime applicable to their marriage.

2. That the Registrar of Deeds, Mpumalanga, be authorised and directed to register the aforesaid Notarial Contract.

3. That the order granted in paragraphs 1 and 2 above:

3.1. shall lapse if the Notarial Contract is not registered by the Registrar of Deeds within three (3) months from

the date of this Order; and

3.2. shall not prejudice the rights of any creditor of the Applicants existing as at the date of registration of the Notarial Contract.

4. Further and/or

alternative relief.

TAKE NOTICE FURTHER
that the Founding Affidavit of SAMKELWA ALLAN GALELA and the Supporting Affidavit of the Second Applicant,
NYIKO GUGU MAHLANGU, will be used in support

of this application.
