BE PLEASED TO TAKE NOTICE that an Application will be made to the above Honorable Court on:
18 DECEMBER 2026 at 10h00, or as soon thereafter as the matter may be heard for an Application for Warrant of Immovable Property (Rule 46 (1)) to be granted against the 1st Respondent for an Order, for:
1. An Order declaring the following mortgaged property specially executable: A unit consisting of:
a) Section NO 47 as shown and more fully described as Sectional Plan NO. SS2/2012, in the scheme known as VILLAGE GREEN 2A in respect of the land and building or building situate at ERF 4081 TASBETPARK EXTENSION 24 TOWNSHIP, LOCAL AUTHORITY: EMALAHLENI LOCAL MUNICIPALITY LOCAL COUNCIL of which Section the floor area, according to the said sectional Plan, is 102 (ONE HUNDRED AND TWO) square metres in extent, and
An undivided share in the common property in the scheme apportioned to the said section in accordance with the participation quota as endorsed on the said sectional plan. HELD BY CERTIFICATE OF REGISTERED SECTIONAL TITLE NUMBER ST387/2012
ALSO KNOWN AS: UNIT 47 VILLAGE GREEN 2A, TASBETPARK, WITBANK, 1035
2. An order authorizing the issuing of a warrant of execution and directing execution against the immovable property;
3. An Order whereby the immovable property known Section NO 47 as shown and more fully described as Sectional Plan NO. SS2/2012, in the scheme known as VILLAGE GREEN 2A in respect of the land and building or building situate at ERF 4081 TASBETPARK EXTENSION 24 TOWNSHIP, LOCAL AUTHORITY: EMALAHLENI LOCAL MUNICIPALITY LOCAL COUNCIL of which Section the floor area, according to the said sectional Plan, is 102 (ONE HUNDRED AND TWO) square metres in extent, and An undivided share in the common property in the scheme apportioned to the said section in accordance with the participation quota as endorsed on the said sectional plan.HELD BY CERTIFICATE OF REGISTERED SECTIONAL TITLE NUMBER ST387/2012. ALSO KNOWN AS NO UNIT 47 VILLAGE GREEN 2A, TASBETPARK, WITBANK, 1035 (herein after referred to as `the property`) is to be sold at a sale in execution without a reserve price;

HELD BY CERTIFICATE OF REGISTERED SECTIONAL TITLE NUMBER ST387/2012
ALSO KNOWN AS UNIT 47 VILLAGE GREEN 2A, TASBETPARK, WITBANK, 1035 (herein after referred to as “the property”) is to be sold at a sale in execution at a reserve price determined by this Honorable Court;
5. The Sheriff be authorized to sell the immovable property to the highest bidder at the sale in execution should the reserve price requested in prayer 4 not be achieved;
6. The Applicant is granted leave to approach the Honorable Court again for a reviewed reserve price should the Applicant require that a reviewed reserve price be set;
7. Cost of suit on attorney and own client scale;
8. Further and/or alternative relief.
