Take further notice that a copy of the Plaintiff`s Combined Summons is pinned to the notice board in the High Court of South Africa, Mpumalanga Division, Middelburg, for inspection for a period of 10 days;
Take further notice that a copy of the Plaintiff`s Combined Summons can be collected from the Plaintiff`s attorneys of record at 299 Pendoring Office Park, 299 Pendoring Avenue, Blackheath, Johannesburg and at their correspondent`s offices at Suite 4, Second Floor, 29 Walter Sisulu Street, Middelburg.
SUMMONS
INFORM the Defendant, an adult male whose full and/or further particulars are to the Plaintiff unknown THAT: The Plaintiff institutes action against him in which they claim: 1. Confirmation of the cancellation of the contract; 2. Repossession of the GOODS being a 2022 RENAULT KWID 1.0 DYNAMIQUE / ZEN 5DR with ENGINE NUMBER: B4DA404E217456 and CHASSIS NUMBER: MEEBBA00700798893; 3. Liquidated damages; 4. Cost of suit on the attorney and client scale; 5. Interest calculated on prayer 3 at the interest rate of 11.06% per annum as from date of Summons to date of payment; 6. Payment of any arrear or additional interest that might be due as at date of cancellation of the agreement; 7. Further and/or alternative relief.
INFORM the Defendant further that if he disputes the claim and wishes to defend the action he shall within TEN (10) days of the substitutive service of this summons, file with the Registrar of this Court, Mpumalanga Division, Corner Dr Beyers Naude and OR Tambo Street, Middelburg, notice of the Defendant`s intention to defend and serve a copy thereof on the attorneys of the Plaintiff, which notice shall give an address (not being a post office or poste restante) referred to in Rule 6(5)(b) for the service upon the Defendant of all notices and documents in the action;
INFORM the Defendant further that if he fails to file and serve notice as aforesaid, judgement as claimed may be given against him, without further notice to him, or if, having filed and served such notice, he fails to plead, except, make application to strike out or strike out or counter- claim, judgement may be given against him.
