Mthimkhulu family home not for sale

The family, with the help of the EFF in Ward 43, fought tooth and nail to stop the illegal sale.


What would have been a sad day for the Mthimkhulu family turned into a victory after they received help when the family home was due to be sold at auction on May 10. According to the family, a relative tried to trick them and wanted to sell the house without including and discussing it with them.

The problem started after their grandmother, who had been living in the home with Muzi, Zama, Jomo, Fana and Nkosana Mthimkhulu, died after an illness. Muzi Mthimkhulu said that he saw the posters advertising the auction a day before it was supposed to occur and he sprang into action.

He said, “I approached Legal Aid, the police and went to several places to ask for help, but no-one was able to assist us.”
“With a bit of luck, Zama came to the rescue as she told her mother about a meeting at 5 pm. We met with Phillip Kungoane and told him our story.”

Phillip Kungoane, Zama Khumalo and Muzi Mthimkhulu fought to save the family home from being illegally sold.

According to Muzi, the family were evicted from the home and their furniture was destroyed and the curtains burnt during what they perceived to be an unlawful eviction.On the morning of May 9, the family went to no 84 Market Street in the Johannesburg Central Business District and drafted an interdict to prevent the house from being auctioned.

On the day of the auction, they had to return to the Johannesburg Court and were granted an interdict which effectively meant that the house would not be sold.
“With the help of the EFF members and Phillip Kungoane, we were able to save our house from being sold. We thank them for the free help they offered us- if it wasn’t for them, we would have been kicked out and the house sold to other people,” said Mthimkhulu.

Ward 43 EFF chairperson, Phillip Kungoane sent a strong message to warn against illegal evictions and advised parents and grandparents to draft documents appointing persons who would be responsible for the house in the event of the homeowner’s death.

Kungoane said, “We are calling on all those who are facing similar problems to stop by at Totomeng Primary School from 6 pm onwards and we will ensure that their issues are resolved.”
