Ngema’s sentence was passed last week in the Witbank Magistrates Regional Court.
Ngema was facing two charges, one for murder and one for robbery with aggravated circumstances.
He was found not guilty of murder, however the magistrate found him guilty of culpable homicide and sentenced him to six years’ imprisonment. He was also found guilty of robbery with aggravated circumstances.
Both sentences are to run concurrently – sentences that may all be served at the same time, with the longest period controlling, are concurrent sentences. Judges and magistrates may sentence concurrently out of compassion, plea bargaining, or the fact that the several crimes are interrelated. When the sentences run one after the other, they are consecutive sentences.
Ngema applied for an appeal for bail to be granted, this remains to the magistrate to decide. Ngema was declared unfit to possess a firearm, according to the Firearms Act.
Two warrants of arrest have been issued in B-Court of Witbank Magistrate’s Court.
The first is for Sibusiso Nhlapo for dealing in drugs, the warrant is to be handed over on December 4.
The second is for Vugrswa Mfana for theft, the warrant is to be handed over on December 12.
Both accused bail was provisionally forfeited to the state for failing to appear before the court.
