NOTICE OF BASIC ENVIRONMENTAL ASSESSMENT PROCESS IN TERMS OF SECTION 24 G OF NEMA 1998 (Act No. 107 of 1998) FOR THE PLANTING OF REMOVAL OF INDIGENOUS VEGETATION AND CONSTRUCTION OF A DAM AT MOOIPLAATS FARM IN MPUMALANGA PROVINCE.
Notice is hereby given following regulations in terms of section 44(i)(ac) of the National Environmental Management Act, 1998 (Act No. 107 of 1998) Section 24G as amended and issued in Government Gazette of
20 July 2017. Notice No. 698.
That Prestige lifestyles grand has proposed and started removing indigenous vegetation and constructed a dam at Mooiplaats farm number 147 JT Mpumalanga Province.
In accordance with Section 24 G of NEMA 1998 (Act No. 107 of 1998) as amended, the project requires Environmental authorisation from the Mpumalanga department of Agriculture, rural development, land and Environmental affairs (M- DARDLEA) as it is a listed activity in terms of listing notice 1 (GNR983) of the EIA regulations 2014 (as amended).
Below is a description of applicable activities as provided for in listing notices for which a basic environmental assessment application process is required:
The clearance of an area of 1 hectares or more, but less than 20 hectares of indigenous vegetation, except where such clearance of indigenous vegetation is required for- Listing Notice 1 Activity 27.
The infilling or depositing of any material of more than 5 cubic meters into or the dredging, excavation, removal or moving of soil, sand, shells, shell grit, pebbles or rock of more than 5 cubic metres from:
