TO: ABEDNIGO LUCKY MSWELI, an adult male whose full and/or further particulars are unknown to the Plaintiff. TAKE NOTICE THAT the Plaintiff institutes action against the Defendant arising from the Defendant`s breach of written and oral lease agreements concluded in respect of Flat 6 and Flat 14, Villa Ridge Properties, Allanridge, and for arrear rental, associated charges and related relief. INFORM THE DEFENDANT further that if he disputes the claim and wishes to defend the action he shall within ten (10) days after publication and/or substituted service of this summons file with the Clerk of this Court and serve on the Plaintiff`s Attorneys notice of his intention to defend. VILLA RIDGE PROPERTIES (PTY) LTD, a private company duly incorporated according to the company laws of the Republic of South Africa, with registration number 2013/167729/07 and principal place of business at Villa Ridge Properties, Otter Street, Allanridge, hereby institutes action against the Defendant on the following grounds:

1. Payment of the amount of R83 209.83;

2. Interest thereon at the prescribed rate from date of service of summons to date of final payment;

3. An order confirming the Plaintiff`s tacit hypothec over the Defendant`s movable property situated at Flat 14, Villa Ridge Properties, Allanridge;

4. An order authorising the Sheriff to attach and remove the said movable property;

5. Costs of suit;

6. Further and/or alternative relief.

INFORM THE DEFENDANT that if he fails to file a notice of intention to defend this action, judgment may be granted against him without further notice.
