Start of the trial postponed

A man made his first appearance in Springs Regional Court One, on Tuesday, facing charges of rape and aggravated robbery.

The case relates to an incident which took place in December at the dilapidated unused mine shaft, in KwaThema, known as Shaft Five.

Magistrate Roy le Roux postponed the start of the trial to July 23, pending the outcome of DNA results.

The man, who has not been asked to plead, is currently out on bail of R1 000, granted during his bail application in February.

He is alleged to have attacked a trio with a gun while they were doing a photo shoot at the shaft, raping one girl and robbing another woman and a man of their cellphones.

While KwaThema Police Captain Mandla Phori went on record saying there was no case opened, the victims and the accused have expressed concern with the manner in which the case was handled by police.

The grandmother of one of the victims said until they were subpoenaed last week, the last time they heard anything about the case was shortly after the man’s arrest in January.

She said they were told the victims would be contacted to participate in an identity parade, but that never happened.

She adds they were informed by the police at the time, that this needed to happen before the man could be granted bail.

The accused says that he too pleaded with police for an identity parade, as he is confidant this is a case of mistaken identity.

Efforts to try and get comment from KwaThema police were unsuccessful.
