WATCH: High court clears City of Ekurhuleni to evict Airport Park Phase 2 residents

Residents in Airport Park Phase 2 were evicted by the CoE.

Airport Park Phase 2 residents were evicted on January 19.

This action follows a statement by the city that the Sheriff of the Court acted in accordance with an eviction order, adding that the judgment issued by the Gauteng Division of the High Court in Johannesburg granted it permission to proceed with the evictions.

“The eviction arises from a court order granted in favour of the Ekurhuleni Housing Company,” stated the city’s head of the Department for Communications, Marketing and Tourism, Phakamile Mbengashe.

Mbengashe said the court dismissed an application for reconsideration and confirmed that the occupation of the affected properties was unlawful in terms of the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, 1998 (PIE Act).

The court order directed that:
• unlawful occupiers vacate the properties on or before January 15, 2026;
• in the event of non-compliance, the Sheriff of the Court, assisted by the SAPS and the EMPD, is authorised to carry out the eviction; and
• certain identified households be expressly excluded from eviction in terms of the directive.

However, residents have condemned the CoE’s action, refusing to acknowledge that the courts issued a verdict on their interdict application.

Law enforcement officers were at the scene as residents unpacked their belongings and attempted to salvage what remained of their furniture and clothing.
