Appeal application of convicted Kloof road rage murderer refused

The defence filed the application for leave to appeal to determine whether a failure of justice materialised during proceedings.

THE Pinetown Regional Court on Wednesday (September 30) refused Anthony Edward Ball’s application for leave to appeal his sentence and conviction for a 2022 Kloof road rage murder.

Ball was recently sentenced to 12 years’ imprisonment for the murder of Dean Charnley during a road rage incident in the Kloof area in 2022. Ball had pleaded not guilty to the murder.

Ball’s legal representative, Advocate Gideon Scheltema, had previously told the court that the defence had filed the application for leave to appeal so that a higher court could determine whether a failure of justice materialised during proceedings.

On September 23, the court heard that Ball had fallen ill and had been hospitalised at the Westville prison.

Ball’s conviction and sentencing have drawn differing views from the public on social media, with some suggesting that his age should have been taken into consideration when a judgment on the matter was made.

Others, however, believed the punishment fit the crime.
