A quest for justice

A mother seeks justice for her child who was allegedly assaulted by three women.

TWO women are expected to appear at the Pinetown Magistrate’s Court for a case of assault. Nobahle Magubane lives in fear for her child who was allegedly assaulted by the two women and a third woman who has not been arrested as yet.

KwaZulu-Natal police spokesperson Colonel Robert Netshiunda confirmed the incident, saying the two women were arrested and charged with assault. “The complainant alleged that on 29 October 2022, she was hiking along 39th Avenue in Clermont when she was assaulted by the suspects,” he said.

“I was in my house doing some chores when someone came running to me telling me that someone was beating my child on the streets. When I went to the scene, I found a crowd with my child being beaten by three grown women. I approached them to ask what was happening. No one answered me, and instead, I was also beaten.

“When the chaos finally died out, I asked my daughter what happened. She told me that she was accused of making fun of one of the ladies who was apparently drunk,” she said.

Magubane said she is still puzzled about why her child was beaten for that. “She was brutally beaten and had to be sent to the doctor for examination. Her abdomin was injured to a point where she couldn’t urinate, and she was bruised all over and could barely move,” she said.

She said she has been supported by the community of Clermont to open a case and go the legal route to find justice for her child.

“There were a lot of difficulties in opening the case because I am not familiar with legal terms and procedures. Sihle Khanyile, who is a community activist, stood up for me, and we finally went to court,” she said.

Khanyile said it was important for the accused to have their day in court. “We are not a registered organisation but community members who are willing to offer help where it is needed. Violence is not acceptable, and it is important for the victims to find justice,” he said.
