WATCH: Murder accused abandons bail, stays in police custody

The case has been postponed to October 2 for further investigation.

The 33-year-old man accused of the murder of Hlengiwe Msimago (30) from Birch Acres abandoned his bail application on August 18.

Mosa Ntsibande appeared in the Kempton Park Magistrate’s Court where he was expected to apply for bail in front of Magistrate Veena Krishna via the audio-visual remand (AVR).

The case has been postponed to October 2 for further investigation.

Ntsibande will remain in custody. Msimango was allegedly shot and killed on August 3 in her Birch Acres home in Kempton Park. Express previously reported Ntsibande had told police he believed she was an intruder.

Msimango, popularly known as Pearl, is survived by her two children, a three-year-old daughter and an eight-month-old son. Pearl was laid to rest in Durban on August 15.

“As Ulrich Roux and Associates (URA) we are pleased that Ntsibande will remain in custody while we assist the SAPS and the National Prosecuting Authority in their investigation,” said Vanessa da Silva Faria from URA, the law firm appointed to represent Msimango’s family.

Covid-19 regulations implemented at the court hindered the family and members of the public from joining court proceedings. Da Silva Faria found it unfair for the family to not witness the court proceedings.

“I explained to the family what transpired in the courtroom as they weren’t allowed to be present in court because of Covid-19 regulations.” Community members were outside the court when he first appeared, demanding justice for Pearl.

“We appreciate the cooperation and the public’s turnout to show their support,” said da Silva Faria.

“We appreciate the citizens for taking their time in supporting the family. A petition urging bail not be granted was also compiled. The public’s presence was felt.”

Msimango’s mother, Thandi Kunene, said: “I will fight till we get justice.”
