After a gruelling four-year trial a man (65) from Denneoord in George, who was accused of raping his minor granddaughter, was found not guilty in the Thembalethu Regional Court.

During judgment on June 7, Magistrate Eugenia Jacobs pointed out significant contradictions in the medical evidence presented. These discrepancies played a crucial role in the final decision.

The George Family Violence, Child Protection and Sexual Offences Unit investigated the case following the alleged incident on May 23, 2020.

The trial commenced with the state presenting a robust case, featuring testimonies from the victim, her mother, and the doctor who examined the victim. These key witnesses laid the foundation of the prosecution’s argument, detailing the events and subsequent medical examination.

However, the state’s case was met with a formidable defence. Represented by Adel Kruger Attorneys and advocate Werner Calitz, the defence systematically challenged the prosecution’s claims. The accused took the stand, as well as several witnesses, including a medical doctor who cast doubt on the findings of the J88, the medical report documenting the complainant’s injuries.
