Alleged Islamophobic attack: Durban man due back in court
A man accused of a Glenmore resident's murder, as well as the attempted murder of her husband and son, will appear in court again before being admitted to Fort Napier Hospital for observation.
After two failed attempts to get Glenmore, KZN, murder accused Grayson James Beare in the dock in the Durban Magistrate’s Court, his lawyer Nyameko Jodwana has confirmed that he will appear in front of the magistrate on April 15.
“He has to appear in court before he is admitted to Fort Napier Hospital on April 15 for his assessment,” said Jodwana.
Berea Mail reports that Beare stands accused of killing Glenmore mother, Halima Hoosen-Preston, in an alleged Islamophobic attack, on June 2, 2024.
He also faces two additional charges of attempted murder, after he allegedly stabbed Hoosen-Preston’s husband and teenage son multiple times during an attack that took place on Hyder Road.
Beare, who is the adopted and estranged son of the chairperson of Beare Holdings, Julian Beare, was due to appear in courtroom 11 at the Durban Magistrate’s Court on March 20 but was a no-show. “He was sick with flu and could not appear in court on that day,” said Jodwana.
Following his failure to appear on March 20, the matter was adjourned to March 28, but again Beare did not appear in court despite being brought to court from Westville Prison.
“There was confusion with the dates. He is not supposed to be here today,” said Jodwana after the matter was removed from the roll last Friday. “He was brought in on the wrong day. Correctional Services should have brought him to court on April 15. From there, he will go to Fort Napier Hospital for 30 days observation.”
At Fort Napier Hospital in Pietermaritzburg, the accused will be assessed by two doctors who will determine his state of mind and if Beare is fit to stand trial for the murder of Hoosen-Preston and the attempted murder of her husband and son.
Beare, who was arrested shortly after the horrific attack, was deemed fit to stand trial by the district surgeon last year following his arrest.
In August, Jodwana filed a Section 77 application for a mental evaluation, which was granted by Magistrate Ashwin Singh.
