Musician’s bail appeal postponed in Polokwane court

Lehlogonolo ‘Shebeshxt’ Chauke faces 20 charges, including three of attempted murder, robbery with aggravating circumstances and assault in Limpopo.

The bail application of a well-known musician continued his bail application at the Polokwane High Court today (May 27), reports Polokwane Review.

Lehlogonolo ‘Shebeshxt’ Chauke’s legal representative Michael Khumalo approached the High Court for an appeal of the recent judgement that was handed down by Magistrates Godfrey Netshiozwi on April 30.

The third bail application was based on new facts; however, Netshiozwi noted that the facts presented were initially in the bail application and could not count as new facts.

This included his need for an urgent leg operation.

Netshiozwi noted that it was not serious, as the Correctional Services facility in Polokwane, where he is currently placed, does not show any record of him lodging complaints to the prison officials.

“The evidence from one of the managers in the correctional service suggested that if the prisoner has a complaint, such a complaint is recorded in a register. Ever since the incarceration of the applicant in the correctional service, he has never made any request or complaint,” he said, delivering the judgment.

The new legal argument

During the appeal, Khumalo noted that the issue of an urgent medical leg operation was supposed to be taken as a new fact.

He also argued that Netshiozwi was not supposed to preside on the matter as he was the one who signed the J50 warrant of arrest.

Chauke faces 20 charges including three of attempted murder, robbery with aggravating circumstances and assault with intent to cause grievous bodily harm (GBH) among others.

What’s next

Presiding judge in the appeal, Karin Pillay postponed the application to June 12 so the state can submit supplementary heads of argument to the defence.

The musician made his first appearance at the Polokwane Regional Court on May 15 and is expected to appear again tomorrow (May 28).
